Filing accurate and timely tax returns is an important obligation for all taxpayers. If you fail to do so, you may face legal consequences, as demonstrated by the recent case of Gaston Gilberto Reyes, a Maryland security guard who was convicted of tax evasion by a federal jury. If you have failed to file a tax return for one or more years, or have taken a position on a tax return that could not be sustained upon audit, it is in your best interest to contact an experienced criminal tax defense attorney to discuss your options.
Defendant Underreported a Significant Amount of Income
According to court statements, Reyes did not file income tax returns with the IRS for the years 2015 through 2020. During this period, he did not report more than $1.15 million in total wages from employment at eight different security firms in the Washington, D.C. metropolitan area. Reyes also submitted false Forms W-4 to his employers, claiming that he was exempt from federal income tax withholding, causing the employers to withhold little or no taxes from his wages. As a result, he did not pay approximately $200,000 in income taxes over the six-year period.
Reyes is scheduled to be sentenced on February 21, 2023 and faces a maximum penalty of five years in prison on each of six charges of tax evasion. He also faces a period of supervised release, restitution, and monetary penalties. A federal district court judge will determine his sentence based on the U.S. Sentencing Guidelines and other statutory factors.
