A Nevada dentist recently pleaded guilty to failing to comply with federal employment tax laws. As our frequent readers know, the IRS takes employment tax law violations very seriously. If you have failed to comply with federal employment tax laws or have failed to file an accurate tax return for one or more years, you should contact an experienced business tax defense attorney to determine your potential exposure and how to get right with the government.
Defendant Withheld, but Failed to Pay Over Incomes Taxes From Employees Paychecks
According to a Department of Justice press release, Dr. Timothy Wilson, from Phoenix, Arizona, owned and operated a pediatric dental practice in Las Vegas called Starsmiles Children’s Dentistry. As the sole owner of the practice, it was his responsibility to collect and remit to the IRS all income, Medicare, and Social Security taxes that were withheld from the wages paid to his employees.
However, between 2011 and 2014, Dr. Wilson failed to pay over these withheld taxes to the IRS, resulting in a tax loss of $289,654.63. He will be sentenced on April 24, 2023 and faces a maximum of 5 years in prison. In addition to a prison sentence, he may also be subject to a period of supervised release, restitution, and monetary penalties.
