    Penalties for Failure to File or Pay Taxes

    “Back taxes” is a broad term that refers to unfiled tax returns and the associated unpaid tax debts. Unfortunately for taxpayers, both are serious issues, regardless of whether the back taxes are associated with local/municipal taxes, state taxes, or federal taxes. Unfiled or unpaid income taxes, payroll taxes, or other types of taxes can all generate civil penalties.

    If the failure to file or failure to pay was “willful,” or deliberate, or Spies Evasion Factors exist, the back taxes could even lead to a criminal investigation for tax evasion or related tax fraud offenses. Under 26 U.S. Code § 7201, “Any person who willfully attempts… to evade or defeat any tax… or the payment thereof shall… be guilty of a felony and, upon conviction… shall be fined not more than $100,000… or imprisoned not more than 5 years, or both, together with the costs of prosecution.”

    Even in strictly civil cases, there are substantial penalties for failure to file and, albeit to a lesser extent, failure to pay. The failure-to-file penalty will be imposed if both of the following are true:

    1. You file the tax return after the applicable deadline. The deadline to file an income tax return is normally April 15. However, the deadline to file a 2017 return – meaning the return you file in 2018 – was April 17.
    2. You did not obtain a tax filing extension for the pertinent return. To get the extension, taxpayers must file Form 4868 (Application for Automatic Extension of Time to File U.S. Individual Income Tax Return) before the filing due date.

    The failure-to-file penalty is capped at 5% of the unpaid tax amount, applied toward each month or partial month the return goes unfiled. However, the IRS will not impose a penalty greater than 25% of the unpaid amount.

    Needless to say, failing to file a tax return will also prevent the taxpayer from receiving, if he or she is eligible, a tax refund, creating yet another financial loss for the taxpayer. The taxpayer will permanently lose his or her rights to a refund, where applicable, if the tax return is more than three years late.
