California Woman Sentenced to Five Years in Prison for Role in Tax Scheme

Table of Contents

According to a Department of Justice press release, a California woman was recently sentenced to serve more than five years in federal prison after she and her husband were convicted of a multi-million dollar tax fraud and money laundering scheme. Although the crime in this case is sophisticated in nature, the IRS does not only target those involved in complex fraudulent activity. If you failed to file a tax return for one or more years or have taken an unsupportable position on a tax return, you should contact an experienced tax defense attorney to work toward getting right with the government.

Note: As long as a taxpayer that has willfully committed tax crimes (potentially including non-filed foreign information returns coupled with affirmative evasion of U.S. income tax on offshore income) self-reports the tax fraud (including a pattern of non-filed returns) through a domestic or offshore voluntary disclosurebefore the IRS has started an audit or criminal tax investigation / prosecution, the taxpayer can ordinarily be successfully brought back into tax compliance and receive a nearly guaranteed pass on criminal tax prosecution and simultaneously often receive a break on the civil penalties that would otherwise apply.

It is imperative that you hire an experienced and reputable criminal tax defense attorney to take you through the voluntary disclosure process. Only an Attorney has the Attorney Client Privilege and Work Product Privileges that will prevent the very professional that you hire from being potentially being forced to become a witness against you, especially where they prepared the returns that need to be amended, in a subsequent criminal tax audit, investigation or prosecution.

Moreover, only an Attorney can enter you into a voluntary disclosure without engaging in the unauthorized practice of law (a crime in itself). Only an Attorney trained in Criminal Tax Defense fully understands the risks and rewards involved in voluntary disclosures and how to protect you if you do not qualify for a voluntary disclosure.

As uniquely qualified and extensively experienced Criminal Tax Defense Tax Attorneys, KovelCPAs and EAs, our firm provides a one stop shop to efficiently achieve the optimal and predictable results that simultaneously protect your liberty and your net worth. Defendants Aimed to Steal Millions from the IRS

Court documents reveal that Ronda Boone, of Vallejo and her husband, Marty Marciano Boone, devised and executed a fraudulent tax scheme whereby they both filed tax returns claiming millions of dollars of tax refunds. While Ronda Boone’s refund request was flagged as fraudulent and was not paid out, Marty Boone’s request for refund was granted and the IRS dispatched a check to him in the amount of $1.9 million.

To hide the source of the fraudulent IRS refund, the couple laundered the funds through both domestic and international entities, including churches. In 2019, Marty Boone was found guilty of filing a false tax return, conspiracy to commit money laundering, and money laundering, while finding Ronda Boone guilty of conspiracy to commit money laundering and money laundering. Marty Boone was sentenced to serve seven years and three months while Ronda Boone was sentenced to serve five years in prison and pay over $1.9 million in restitution to the IRS.

Coming into Compliance With the Help of a Tax Attorney

The defendants in this case had an obvious motive to defraud the IRS. But similar prosecutions involve defendants and situations that do not have such a clear criminal intent. For instance, filing a tax return with understated income or inflated business expense or claiming credits for which you are not entitled does not seem as severe as the actions of the defendants in the case above, but such fraudulent activity is certainly and repeatedly prosecuted in courts around the nation.

If you have either failed to file a tax return for one or more years or have understated income, inflated deductions, or claimed credits for which you are not entitled, it is in your best interest to seek the assistance of an experienced tax defense attorney. Together, you can develop your set of facts, establish a strategy to come into compliance, and execute that strategy. One of the most valuable benefits of being represented by a seasoned tax lawyer is never having to go up against the IRS alone.
