New Orleans Judge Indicted on Tax Charges, Faces Federal Prison

Table of Contents

According to a Department of Justice press release, a New Orleans judge was recently indicted for filing false tax returns after allegedly having concealed income earned from officiating marriage ceremonies. This story demonstrates that no one, even government officials, are above complying with federal tax laws. If you have failed to file a tax return for one or more years, or have filed a tax return that does not accurately reflect your true income, it is in your best interest to contact an experienced tax lawyer to determine the best strategy to get right with the government.

Note: As long as a taxpayer that has willfully committed tax crimes (potentially including non-filed foreign information returns coupled with affirmative evasion of U.S. income tax on offshore income) self-reports the tax fraud (including a pattern of non-filed returns) through a domestic or offshore voluntary disclosurebefore the IRS has started an audit or criminal tax investigation / prosecution, the taxpayer can ordinarily be successfully brought back into tax compliance and receive a nearly guaranteed pass on criminal tax prosecution and simultaneously often receive a break on the civil penalties that would otherwise apply.

It is imperative that you hire an experienced and reputable criminal tax defense attorney to take you through the voluntary disclosure process. Only an Attorney has the Attorney Client Privilege and Work Product Privileges that will prevent the very professional that you hire from being potentially being forced to become a witness against you, especially where they prepared the returns that need to be amended, in a subsequent criminal tax audit, investigation or prosecution.

Moreover, only an Attorney can enter you into a voluntary disclosure without engaging in the unauthorized practice of law (a crime in itself). Only an Attorney trained in Criminal Tax Defense fully understands the risks and rewards involved in voluntary disclosures and how to protect you if you do not qualify for a voluntary disclosure.

As uniquely qualified and extensively experienced Criminal Tax Defense Tax Attorneys, KovelCPAs and EAs, our firm provides a one stop shop to efficiently achieve the optimal and predictable results that simultaneously protect your liberty and your net worth. Sitting Judge Allegedly Hid Income From the IRS

Court documents reveal that Ernestine Anderson-Trahan, a Second City Court judge in the Parish of New Orleans, Louisiana, allegedly earned substantial amounts of money officiating marriage ceremonies between 2013 and 2016. Federal prosecutors allege that during that same period, the defendant failed to reflect such income, which was commonly paid in cash, on her federal income tax returns. Additionally, federal prosecutors allege that on the defendants 2013 and 2014 tax returns, she intentionally failed to include income earned by providing legal services prior to becoming a judge.

If the defendant is convicted of the four counts of filing a false tax return, she faces up to three years in prison for each. Additionally, the defendant may be sentenced to a period of supervised release to commence upon the completion of her physical incarceration. Lastly, the defendant may be ordered to pay restitution to the IRS, representing the total amount of tax loss caused.

Coming Into Tax Compliance After Falling Behind or Filing False Returns

This story represents the fact that all Americans are bound by the tax laws of the United States. Although some taxpayers believe that certain individuals, including judges, may be above the law, that is simply not the case. A criminal investigation and subsequent criminal tax prosecution can carry significant civil penalties, as well as the potential for physical incarceration. Luckily, the IRS has established several programs to allow taxpayers who have fallen behind to come back into compliance. Similarly, an experienced tax defense attorney is uniquely positioned to provide advice to help bring you back into tax compliance while attempting to minimize some of the civil and criminal penalties that are associated with a criminal investigation or prosecution.

If you have failed to file a tax return for one or more years or have filed a tax return that understates income or overstates deductions, it is in your best interest to seek counsel from a seasoned tax attorney. Together, you will determine the pertinent facts of your situation and arrive at a conclusion as to next steps to come into federal income tax compliance. While you are being represented by a seasoned tax attorney, you won’t have to go up against the IRS or Department of Justice alone.
