New York Man Pleads Guilty to Multiple Tax Counts, Faces Prison

    According to a Department of Justice press release, a New York man recently pleaded guilty to several counts related to filing false federal income tax returns and lying to the IRS when they attempted to commence collection efforts.     Defendant Filed False Tax Returns and Lied to IRS About Ability to Pay

    Court documents reveal that Mario Nunez recently pleaded guilty to tax evasion and filing federal income tax returns. Federal prosecutors alleged that the defendant filed false federal income tax returns for tax years 2012 through 2017. Prosecutors allege that the tax returns filed during those years significantly understated income that the defendant had earned working in construction. Additionally, prosecutors allege that between 2014 and 2019, the defendant made various false statements to IRS agents attempting to collect his delinquent tax debt. Court filings indicate that the defendant told the IRS that he was out of work, only surviving with assistance from his family. Prosecutors alleged that in actuality, the defendant was earning a substantial amount of income and avoiding detection by the IRS by cashing checks from customers rather than depositing the funds into his bank account.

    The defendant will be sentenced later this year. He faces up to five years in prison for each count of tax evasion. Additionally, the defendant faces up to three years in prison for each count of filing a false tax return. The defendant also faces a period of supervised release to commence upon the completion of any physical incarceration. Lastly, the defendant has agreed to pay restitution to the IRS in the amount of $330,000, representing the total tax loss that he caused.
